By accessing or using our website at www.recruiterhi.com (the "Site"), our mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

These Terms and Privacy Policy apply to all users of the Services, including but not limited to job seekers ("Candidates"), recruiters, employers, and visitors. We may update these Terms and Privacy Policy from time to time. We will notify you of material changes by posting the updated version on the Site and updating the "Last Updated" date above. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms and Privacy Policy.

Terms of Service

1. Description of Services

Recruiter Hi is a recruiting platform that connects talented individuals with job opportunities. Candidates can create profiles, upload information about their skills, experience, and preferences, and apply to or be matched with job openings. We facilitate introductions between Candidates and employers, and we earn revenue through standard recruiting commissions upon successful placements. Our Services include profile creation, job matching, communication tools, and related features.

The Services are intended for users who are at least 18 years old and legally capable of entering into contracts. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. User Accounts and Responsibilities

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or use.

You agree not to:

  • Use the Services for any illegal, harmful, or unauthorized purpose.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload or transmit viruses, malware, or any other harmful code.
  • Interfere with or disrupt the Services or servers/networks connected to the Services.
  • Harvest or collect information about other users without their consent.
  • Violate any applicable laws, regulations, or third-party rights.

We reserve the right to suspend or terminate your account at any time for violations of these Terms, without notice or liability.

3. Candidate and Employer Interactions

  • For Candidates: By submitting your information (e.g., resume, profile details, contact info), you authorize us to share it with potential employers or recruiters as part of the matching process. You represent that all information you provide is accurate and truthful. We may use AI or other tools to analyze your data for matching purposes, but we do not guarantee job placements.
  • For Employers/Recruiters: You agree to use Candidate information solely for legitimate recruiting purposes and in compliance with applicable laws (e.g., anti-discrimination laws). You are responsible for your interactions with Candidates and for any hiring decisions.
  • Matches and Placements: We facilitate matches based on profile data, but all hiring decisions are between Candidates and employers. Upon a successful placement, we may earn a commission based on standard industry rates (typically a percentage of the Candidate's first-year salary). Details of commissions will be provided in separate agreements with employers.

4. Intellectual Property

All content on the Services, including text, graphics, logos, software, and databases (collectively, "Content"), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes. You may not copy, modify, distribute, sell, or create derivative works from the Content without our prior written consent.

User-Generated Content: By uploading content (e.g., profiles, resumes, messages), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with providing the Services. You represent that you own or have rights to such content and that it does not infringe third-party rights.

5. Third-Party Services and Data

The Services may integrate or link to third-party services (e.g., LinkedIn, email providers). We are not responsible for the content, privacy practices, or availability of such services. Your use of third-party services is subject to their terms.

We use third-party data sources for certain features, such as location-based services. Specifically:

6. Disclaimer of Warranties

The Services are provided "AS IS" and "WITH ALL FAULTS." We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that any matches or placements will occur.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Services, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if no payments were made).

8. Indemnification

You agree to indemnify, defend, and hold harmless Dispersiv Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware. You waive any objections to venue or jurisdiction.

10. Miscellaneous

  • Severability: If any provision is held invalid, the remainder shall continue in full force.
  • No Waiver: Our failure to enforce any right does not constitute a waiver.
  • Assignment: We may assign these Terms without your consent; you may not assign without our written consent.
  • Entire Agreement: These Terms, including the Privacy Policy, constitute the entire agreement between you and us.

  • Comply with legal obligations and enforce our Terms.

We do not sell your personal information to third parties. We may use aggregated, anonymized data for business purposes (e.g., hiring trends reports).

We share information as follows:

  • With Employers/Recruiters: Candidate profiles and contact info for matching and hiring purposes.
  • Service Providers: Third-party vendors (e.g., cloud hosting like AWS, email services like SES) that assist with operations, bound by confidentiality.
  • Legal Requirements: If required by law, subpoena, or to protect rights/safety.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets.

We implement reasonable security measures (e.g., encryption, access controls) to protect your information. However, no system is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your information as long as necessary for the purposes described (e.g., active profiles during job searches) or as required by law. You may request deletion of your account and data by contacting us, subject to legal obligations.
